The matrimonial law of Singapore categorizes marriages contracted in Singapore into two categories: civil marriage and Muslim marriage. The Register of Marriage (ROM) regulates civil marriages in accordance with the Women's Charter, while the Register of Muslim Marriages (ROMM) governs Muslim marriages in accordance with the Muslim Law Act Administration (AMLA). All marriages made in Singapore must be registered with the relevant registry to be legally valid.

Civil marriage
Civil marriage is for couples where one or both partners are non-Muslims. Polygamy is forbidden.
Legal process
Both parties must register dates either in the Registry of Marriage (ROM) or on the ROM website. The selected date will be at least 21 days after the enrollment date and within three months from the date of registration. Marriage licenses can only be issued on the basis of evidence of a number of conditions (see below) with an official statement. Both parties must appear on their own in the registrar to certify that the marriage they intend to comply with the following matters:
- a) for a spouse where at least one party is not a Singaporean citizen or a permanent resident of Singapore, one of the parties to the intended marriage must be physically present in Singapore for at least 15 days prior to the date of marriage. note, excluding the day of arrival in Singapore;
- b) each party aged 21 years and over, or if not, divorced or widower or widow or has been previously married is declared null and void;
- c) if either party is a minor who has never been married before, the consent of the appropriate person mentioned in Schedule 2 (click here) must have been given in writing or the approval of the High Court has been granted;
- d) no party under the age of 18 (based on the solemnation date);
- e) there is no legal barrier to marriage; and
- f) none of the married parties are meant to marry under any law, religion, custom, or use to anyone other than the person who is married to him for contract.
- g) in which one of the parties to the proposed marriage has been married but is divorced, the party shall also state whether it owes the arrears in respect of any maintenance to be paid on the basis of the maintenance order.
They then have to bring their agreement to a licensed Solemniser, who can be a religious leader (church order, Buddhist, Taoist, Hindu, Sikh), judge, Judge of Peace, and grassroots leader. Marriage counseling is also offered by family service centers supported by the Ministry of Social Affairs and Family Development.
Inter-religious weddings
Interfaith marriage is permissible as civil marriage. A Muslim can marry a non-Muslim partner on a civilian basis (including marriages not allowed under sharia law).

Muslim Wedding
Muslim marriage is for couples where both partners are Muslim. A man can take up to four wives provided he meets financial requirements and obtains the consent of his existing wife.
By law, a Muslim can marry at the age of puberty and where the bride is an unmarried woman (commonly known as a virgin bride or 'virgin'), the guardian must give consent to marriage. The guardian in this case is the biological father, the blood brother, the father's grandfather, the uncle (father's brother) and where a woman is an illegitimate child, a biological mother's solemn declaration must be made in the name of Allah, and the like if the father is no longer known to exist, or has gone and the immediate family is unknown.
In this case, a Wali Judge or the Wali King is called and the guardian or immediate family shall be the administrator of the territory, the country or the like, until the naming of the Judge (the judge) or the King (the King/Sultan in the ancient days of the day). The Kadi (Khadhi) can also quote which party goes with 2 marhalah (about two days on foot, about 90 km), those conditions are filled with God as the Faithful Believer. This tight condition must be met for solemnization of a marriage called Marriage.
If the father is alive but unknown in Singapore, the Registry will issue a petition notice in the local newspaper to have him summoned to the Muslim Court for his marriage to be approved. It takes 30 days.
No guardian is required if the bride is a converting Muslim and is the only one who moves in the family.
The rules of marriage are the presence of the bridegroom, male, two Muslim male or four female Muslim witnesses (independent from the family), the presence of the Wali, Kadi and Mahar or Mas Kawin in the area. Dowry is not mandatory because it is a gift to the bride's family to meet the cost of the wedding. Mahar (currently set at least S $ 200) is equivalent to the cost of a wife to be awarded for upbringing as it is part of Taklik or terms of agreement. Think of it as a benefit.
During registration, the parties must attend (except witnesses) to sign a written statement for the application at ROMM. The groom will sign an appointment for a request and an application to marry and reserve a solemnation date. If Kadi's interview is not satisfied with the needs of Islamic knowledge, he may ask them to take additional classes before allowing them to marry.
Couples must be 21 years old but age 16 is allowed with the consent of the parents present. Bridal weddings under 16 require special permissions.
The couple must attend a marriage counseling course by an approved provider. The certificate issued is valid for only three years.
Nisi's Decision Letter Absolute or divorce certificates are required for the woman if she is married and must end 90 days before the wedding. If the bridegroom has a living wife, the husband is required to show financial evidence to support the wife, and obtain permission of all wives present before the polygamous marriage is approved. A man is allowed to have a maximum of four wives who live at a time.
After satisfying all conditions, a Muslim marriage will take place consisting of a sermon or a marriage sermon, a contract or agreement from both parties and a thanksgiving.
The sermon is basically the sunnah of Muhammad who states that his sunnah is three, from Brushing teeth to ensuring good hygiene, wearing attar and Marriage because he wants to see many followers on the Day of Judgment.
During the contract, Kadi will request the bride's consent for marriage and ask for a signature to be on the certificate and proceed with the agreement in the presence of witnesses. He will ask the guardian to ask him to marry his daughter (or nobleman) on his behalf as by law, he is required to perform a wedding ceremony. The Kadi will do a handshake saying that "I will marry you, Of (bride name) to (bridal name) with Mahr or Mas kahwin of (sum) and in a handshake, she must say she agrees to take the bride to marry the dowry.
After that, the groom will then say aloud taqlik or default terms of marriage can be dissolved by the wife complained to the Shariah court, which hurt him (or his property), do not provide a living it (means sustainability) by him or immediate family for 6 months (thus the amount of dowry) and leaves him for more than six months and in which the court found that the decision will correct the marriage was dissolved by either divorce. The divorce will be settled after 90 days from the marriage divorce.
Singapore Citizens, Permanent Residents (PR) to Non-Singapore
Singaporeans or Permanent Residents wishing to settle their marriages in Singapore or outside Singapore to non-Singaporeans are requested to seek prior approval from the Ministry of Manpower if the intended/male partner holds a Work Permit or is employed to work in Singapore on a Work Permission that has been canceled.
However, you do not need to apply for a prior approval from the Department of Labor if the intended spouse/prospective bride:
Not holding a Work Permit (for example you are the holder of Pass or Work Permit) or Whether the former License holder who last passed the work was transferred to the Pass of Employment or S Pass or Is the former current Work Permit holder is Singapore Citizen or PR Singapore.
If you are required to seek prior approval from the Ministry of Manpower but fail to do so, the privilege of working in Singapore for Singaporean Citizen may be withdrawn by the Department of Labor. You can also be prevented from entering Singapore by the Immigration Department for a certain period of time.
The prior consent is believed to screen among applicants other criteria who previously worked in Singapore without a Work Permit and have illegal employment records with the Work Pass Division, the Ministry of Labor; or for applicants who have not received a MOM Notice on "Exemption of Marriage Restriction Policy" at the points of Work Permit/renewal/cancellation application.
The waiting time of the prior approval application is approximately 4 weeks in which the applicants are notified of the results by post by the Department of Labor.
For couples who are not Singaporean Citizens or Permanent Residents, at least one of the parties to the intended marriage must be physically present in Singapore at least 15 days prior to the date of notification.
same-sex marriage
Same-sex marriage is not allowed in Singapore. Under the category of civil marriage, a person's gender is listed in the National Registration Card. Therefore, a recognized transgender can marry someone who is the opposite sex of his or her gender as stated in the NRIC. On the other hand, in the context of Muslim marriage, a transgender is not allowed to marry regardless of gender changes. This is ignored if the person is born with both genital organs (hermaphrodite or pseudohermaphroditism) and makes a change.
Marriage among members of the Armed Forces â ⬠<â â¬
The Minister of Defense Regulation (MINDEF) states that any marriage between MINDEF members or the Singapore Armed Forces (SAF) must be approved by a G3 personnel officer or army officer. Personnel are encouraged to consult the Chief Employee of the Office (Branch/Executive Administrator) for the latest decision on this matter.
Marriage outside MINDEF/SAF to civilians is permitted and benefits of SAF awards such as breaks and gratuity payments to personnel to marry.
The Official Secrets Act prohibits marriage to foreign nationals, and excludes marriages with foreign government employees, whether employed in civilian, diplomatic or military service.
Staff (mostly civilians) of the Defense Science and Technology Agency and other military bodies have different sets of rules, in accordance with orders and directives related to the Defense Executive Officer (DXO, formerly NUSAF - Non-Uniformed SAF). The civilian staff is partly under the Singapore Armed Forces Act (Civil Action because Singapore has no official military law), mostly with confidentiality, information, professionalism, and conflicts of interest while excluding the normally-applied military discipline on staff in military uniform.
DXO has more stipulations than the DSTA staff.
Information on marriage of military staff and MINDEF is classified as limited and not released to the public.
Divorce
Different divorce procedures for civil marriage and Muslim marriage. Divorce of the civil marriage process is done in the Family Court, while the marriage divorce process of Muslims is conducted in the Sharia Court.
A person may obtain a divorce in the Singapore Family Court if one or both partners are Singaporean Citizen, has lived in Singapore for at least three years, or is domiciled in Singapore. It is recommended that those wishing to divorce first seek legal advice because there are a number of rules to follow. For example, you can not apply for divorce if you have been married for less than three years unless you have Court's permission to do so. Likewise, saving marriages can also seek counseling.
To prove that marriage is over, couples seeking divorce must show to the Court that one or more of the following facts are true:
- that your spouse has committed adultery, and you feel intolerable to live with him or her
- that your partner has behaved in such a way that you can not be expected to live with him or her
- that your partner has left you for at least two years
- if your spouse agrees with the divorce, that you and your spouse have been separated for at least three years
- if your spouse does not agree with the divorce, that you and your spouse have split up for at least four years.
Usually to begin the process of divorce, required 3 step process. First, a person needs to file a divorce certificate, then a special statement and finally a claim statement.
Singaporeans married abroad
The law does not require Singaporeans or Permanent Residents married abroad to re-register (including "amend" or "authorize" a foreign marriage certificate) with Singapore's ROM. A marriage certificate issued by a competent authority of a foreign country may be admitted as prima facie evidence of marriage between the parties mentioned in the certificate.
All marriages contracted or cured outside Singapore -
(A) which has been registered in accordance with and enforceable under the law of place where the marriage is contracted or celebrated; and
(b) where both parties have the capacity to marry under the laws of their respective domicile countries, applies in Singapore.
The final arbiter of any dispute concerning the validity of such marriages in Singapore is the Court of Justice.
