Founded by the legislature in 1976, the Fraud Insurance Division is the enforcement arm of the Financial Services Department and is responsible for investigating insurance fraud; crimes related to claims fraud, insurance premium fraud, employee compensation claims fraud, avoidance and diversion of employee compensation premiums, insurance insolvency fraud, unauthorized insurance entity fraud, and insurance agent crime. Law enforcement detectives from the Fraud Insurance Division are also investigating conscious application deceptions, defaults of escrow funds kept in trust by insurance companies, and non-Medicaid health care scams.

According to a 2007-2008 report from Coalition Against Insurance Fraud (CAIF), Florida Fraud Insurance Division leads the nation in recovering losses related to insurance fraud through courts ordering restitution. In Fiscal Year 2008/2009, the cases filed for prosecution by the Fraud Insurance Division resulted in more than $ 34 million in court ordering restitution. According to 2007-2008 Coalition statistics, Florida ranks at the top four (4) among divisions and fraud bureaus of all states in key success measures:

  • number 2 in the number of captures
  • 3 in the number of cases filed for prosecution
  • 4 in reference count

Florida Fraud Insurance Division continues to lead the fight against insurance fraud under the leadership of Colonel John Askins. During Fiscal Year 2008/2009, investigative efforts by the Fraud Insurance Division resulted in 982 cases filed for prosecution, 834 arrests, and 532 rulings. Also during Fiscal Year 2008/2009, the Fraud Insurance Division received and reviewed 12,084 references of insurance fraud and opened 1,971 cases for investigation.
